Nutrio Physio & Pilates – Terms of Participation and Liability Waiver

Introduction

By proceeding with a booking, attending the studio, or participating in any class, appointment, or programme (including Pilates, yoga, physiotherapy, workshops, and online sessions), you agree to be bound by these Terms of Participation and Liability Waiver.
If you do not agree, you must not attend or participate.

These Terms apply to all clients of Nutrio Physio & Pilates Limited (“we”, “us”, “our”).

Professional Standards (HCPC & CSP Compliance)

All physiotherapy services are delivered exclusively by HCPC-registered physiotherapists and in accordance with:

  • the HCPC Standards of Conduct, Performance and Ethics

  • the Chartered Society of Physiotherapy (CSP) Code of Professional Values and Behaviour

We are committed to providing safe, ethical, evidence-based care.

Voluntary Participation and Assumption of Risk

Participation in Pilates, yoga, physiotherapy, and exercise activities may involve physical exertion and carries inherent risks, including (but not limited to) muscle strain, joint discomfort, falls, and exacerbation of pre-existing conditions.

By participating, you confirm that:

  • you voluntarily assume all associated risks

  • you understand that movement-based activity can be physically demanding

  • you agree to monitor your own wellbeing and stop immediately if you experience discomfort or pain

  • you will inform your instructor/physiotherapist of any medical conditions, injuries, pregnancy, or changes in health that may affect participation

Some exercises are not suitable for pregnancy, osteoporosis, or certain health conditions. It is your responsibility to disclose this information so appropriate modifications can be provided.

Consent to Treatment and Hands-On Guidance

Physiotherapy and certain movement-based coaching may involve hands-on assessment or facilitation.

  • We will always explain the purpose of any hands-on technique.

  • You may decline touch at any time, without affecting your treatment or participation.

  • You may withdraw consent at any time.

Participation in classes is entirely voluntary.

Client Responsibilities

You agree to:

  • follow all instructions for safe execution of exercises

  • inform your instructor of any discomfort, pain, or concerns

  • use equipment safely and only as directed

  • behave respectfully toward staff and other participants

  • attend with appropriate clothing and footwear for movement-based activity

We reserve the right to refuse participation where behaviour or non-disclosure of medical information poses a safety risk.

Specialist Equipment and Studio Environment

Where specialist equipment is used (e.g., reformer, Chair, Trapeze table, Fuse ladder and other studio Pilates equipment, resistance bands, blocks, bolsters, wall anchors):

  • you agree to follow all safety instructions

  • misuse of equipment or failure to follow directions increases risk and is undertaken at your own risk

  • you must notify the instructor of any equipment concerns immediately

Personal Belongings

We are not responsible for loss, theft, or damage to personal belongings brought into the studio.

Accessibility and Reasonable Adjustments

We aim to make our services as accessible as possible and will make reasonable adjustments where feasible.
Please contact us in advance if you require additional support to participate safely.

Consent for Clients Under 16

For clients under 16 years old:

  • consent must be provided by a parent or legal guardian

  • a parent, guardian, or chaperone may be requested to attend sessions

  • refusal to provide appropriate consent will prevent participation

Cancellations, Lateness, and Missed Sessions

To ensure fairness and smooth running of the studio:

  • late arrival may reduce your session time

  • cancellation policies apply to all appointments and classes (see website for details)

  • repeated non-attendance may result in future bookings being restricted

Data Protection, Privacy, and Communication Consent

We process your data in accordance with our Privacy and Cookies Policy, which complies with the UK GDPR and Data Protection Act 2018.

Marketing Consent

Consent for marketing is collected via the online booking system.
To withdraw consent, email hello@nutrio-studio.co.uk with the subject line “Withdraw Consent” and your name.
Withdrawing marketing consent will not affect your clinical care.

Photography and Video Policy

We respect your privacy.

  • We do not record or photograph clients without explicit written consent.

  • Declining consent will never impact your access to care or classes.

Limitation of Liability

Nothing in these Terms limits or excludes liability for:

  • death or personal injury caused by our negligence

  • fraud or fraudulent misrepresentation

  • any other liability that cannot be excluded under Scottish law

Subject to the above, to the fullest extent permitted by law:

  • Nutrio Physio & Pilates is not liable for injuries arising from failure to follow instructions, non-disclosure of health information, or improper use of equipment

  • participation in all activities is undertaken at your own risk

  • we are not liable for indirect or consequential loss, including loss of earnings or enjoyment

Online Classes

If you participate in online classes:

  • you are responsible for ensuring a safe exercise space

  • you must use props and equipment responsibly

  • technical issues or connection problems may affect your session

  • we cannot see everything you do online and therefore cannot be liable for injuries arising from unsupervised activity

Changes to Terms

We may update these Terms periodically.
The most current version will always be available on our website.

Continuing to attend sessions after changes constitutes acceptance of the updated Terms.

Acceptance of Terms

By proceeding with your booking, checking the acceptance box, or attending any class or appointment, you confirm that:

  • you have read, understood, and agree to these Terms

  • you voluntarily accept the risks associated with participation

  • you consent to treatment, instruction, or participation as appropriate

  • you understand you may withdraw consent at any time
